Anampa (National Association of Retired Magistrates from the Judiciary of the Union and Retired Attorneys from the Public Ministry of the Union) defends the government’s attempt to, amid the .
The topic is addressed in the original text of the PEC (proposed amendment to the Constitution) sent by the government on December 3rd. According to the proposal, only compensation installments provided for in a complementary national law applied to all powers and constitutionally autonomous bodies may be excluded from the remuneration ceiling.
Entities representing magistrates and others affected by the measure pressured deputy Moses Rodrigues (União-CE), author of the amendment, so that the change could occur via ordinary law, which requires a smaller quorum. He complied.
President of the entity, Sonia Roberts, a retired labor judge, states that the objective is to “really moralize the issue of subsidies”.
“We know that today there is what we call, in quotation marks, penduricalhos, which are funds with a remunerative nature, but disguised as an indemnity nature”, he says.
“And we understand that this is not good for the country, it is not good for morality, because it was created through resolutions and not through laws, which are the natural and legal way to create adjustments of this nature.”
She specifically mentions the compensatory license, which, according to the association, provides a monthly payment of R$12,000 to R$15,000 without any social security and tax discounts, as it is supposed to be compensation.
The appeal, says Anampa, is paid to each active Union magistrate or attorney from the Public Ministry of the Union, “without any extraordinary work to justify it”.
“For us, this really is not a compensatory amount under any circumstances. It is remunerative.”
Regina Butrus, vice-president of the association and retired regional labor attorney, also defends that the change be made by Congress, and not via resolutions.
