The lawyer criticizes decisions by Minister Alexandre de Moraes, of the (Supreme Federal Court), in relation to the indigenous man from Pará Helielton dos Santos, who has been preventively detained for 15 months at the CMP (Penal Medical Complex), in Pinhais, in the metropolitan region of Curitiba .
“It is not possible for a person to remain in prison for events that occurred two years ago and without a conclusion to the investigation. Minister Alexandre de Moraes has already denied him freedom on five occasions”, says the lawyer, adding that he fears for the man’s health.
According to the lawyer, Helielton was diagnosed “with depression, taking seven medications a day.” “I spoke to him at length via video on Friday and he told me that life has lost its meaning,” said the defender.
Coelho da Silva is a retired judge from the Court of Justice of the Federal District and Territories and has worked in the defense of defendants suspected of participating in undemocratic acts.
Helielton became the target of the STF in the wake of anti-democratic acts that questioned President Lula’s (PT) victory at the polls at the end of 2022. He is suspected of committing crimes such as qualified damage, arson, criminal association, violent abolition of the Democratic State of Law and coup d’état.
In one of the decisions in which he denied freedom to Helielton, the STF minister argued that the exceptional restriction of freedom is possible “given the social danger and the concrete gravity of the conduct attributed to the person being investigated” on December 12, 2022, in Brasília.
Moraes also mentioned that Helielton was considered a fugitive – the arrest was ordered in January 2023, but he was only arrested in September of that year.
Helielton would be part of the group linked to the evangelical and indigenous pastor, known as Cacique Tserere and defender of former president Jair Bolsonaro (PL). Tserere was arrested at the time after carrying out a series of anti-democratic attacks, such as burning cars, vandalizing buses and attempting to invade the PF headquarters in Brasília.
Helielton’s defense maintains that “all he did was go along with other people to protest against the arrest of Chief Teserere”. “He saw the confusion and was so scared that he left. He even left Brasília afterwards and wasn’t even there on January 8th. When he found out that there was something open against him, he went to the police station and introduced himself,” said the lawyer .
The report contacted the Paraná Penal Police to find out about the prisoner’s health situation, but the agency said in a note that “the information in the medical records is confidential.” “Since entering the state prison system, he has been regularly cared for by a multidisciplinary team that includes psychologists and psychiatrists,” he added.
