Maria Cristina de Araújo Rocha, 77 years old, who was arrested in the act on Wednesday the 18th, after committing racial insults against a Federal Police (PF) agent, was released following a decision by judge Marcelo Duarte da Silva, from 2nd Federal Criminal Court of São Paulo.
In contradiction to the position of the Federal Public Ministry, which requested the conversion of the arrest from flagrant to preventive, Marcelo authorized the release of Maria Cristina and granted provisional release to the woman, according to the newspaper O Estado de S. Paulo.
“The crime attributed to the person in custody was not committed with violence or serious threat to the person, so the release, at least in principle, will not bring risks to public order beyond those that society is obliged to bear on a daily basis”, says the decision.
The elderly woman was arrested in the act after calling a federal agent a “monkey”. The crime occurred when she, who is the daughter of a military officer, tried to leave a wreath of flowers on the sidewalk of the residence of President Luiz Inácio Lula da Silva (PT), in São Paulo.
The president was recovering from surgery to drain an intracranial hematoma he had last week. The head of the Executive has already returned to Brasília.
According to information from the newspaper O Globo, the woman is the daughter of an Army general and has received a pension of R$14,500 since 2004. Present at Bolsonaro and right-wing demonstrations for some time, in 2020, she took a baseball bat, with “Rivotril” written on it, to an event on Avenida Paulista.
