The president () will veto the pardon of those convicted of abuse of authority, according to this year’s Christmas pardon decree. The text, obtained by Sheet, is being finalized by the Civil House. The expectation is that the decree will be published in the Official Gazette of the Union by Tuesday (24), Christmas Eve.
According to the document, the president must pardon high-risk pregnant women and those with terminally ill HIV, as long as there is medical proof. The unprecedented measure was anticipated by the newspaper O Globo.
pardon will also be granted to people with serious, chronic or highly contagious illnesses, as well as convicts with severe autism spectrum disorder or other neurodiverse conditions.
This year’s text also repeats the veto against people convicted of crimes against the Democratic Rule of Law, in response to the opposition to the headquarters of the three Powers. The forecast was included by Lula for the first time.
People who committed the crimes of embezzlement and passive corruption against the public administration are also left out, as long as they are sentenced to more than four years in prison.
As in previous years, the pardon also excludes those convicted of heinous crimes (such as qualified homicide and rape), torture, drug trafficking, violence against women, members of criminal factions and inmates who are under a different disciplinary regime.
The prerogative of the President of the Republic, the Christmas pardon implies the pardon of the sentence. The benefit has become traditional throughout history and by the STF (Supreme Federal Court), based on the rules chosen by the president.
