Prosecutor defends maintaining the prison of General Braga Netto

The Attorney General’s Office (PGR) spoke out against a request to revoke the preventive detention of General Braga Netto presented by his defense. The soldier has been arrested since the 14th, on suspicion of trying to obstruct justice in the investigation into a plot after the (PT) victory in the 2022 election.

In the opinion sent to the Federal Supreme Court (STF), the Attorney General of the Republic, Paulo Gonet, says that there is “permanence of the reasons that supported the decree of preventive detention and the absence of new facts that alter the factual evidentiary framework that supported the measure ”.

Four days after the arrest, José Luís Oliveira Lima took over Braga Netto’s defense. In an interview with Estadão, the criminalist stated that “the general did not commit any crime” and ruled out interest in a plea agreement.

The PGR had already expressed itself in favor of preventive detention as it understood that the measure was necessary to avoid interference in investigations into the alleged coup plan by allies of former president Jair Bolsonaro (PL). Gonet stated, at the time, that Braga Netto represents a “concrete risk to the application of criminal law”.

In testimony, Bolsonaro’s former aide-de-camp, lieutenant colonel Mauro Cid, reported that the general tried to influence his testimony. The Federal Police requested Braga Netto’s arrest because they considered that, when free, he represented a risk to public order as he would be capable of committing acts that could interfere with the investigation.
