Lawyer Ariel de Castro Alves, former national secretary for the Rights of Children and Adolescents, criticized the divergence between the government and the National Council for the Rights of Children and Adolescents because of .
Conanda approved this Monday (23) a resolution that says it is the duty of the Union, states and municipalities to ensure that children and adolescents and their families, among other actors, have access to information on sexual and reproductive rights.
Among other points, the resolution indicates that access must be guaranteed to children and adolescents and prohibits “different conduct based on moral, political, religious and personal beliefs.”
The text also states that the absence of parents or legal guardians does not prevent children and adolescents from having the right to information, “and it is mandatory that all information and clarifications regarding termination of pregnancy be provided in a clear and accessible way.”
In Brazil, rape is a risk to the woman’s life and fetal anencephaly. In none of the cases is there a gestational time limit for carrying out the procedure.
The resolution was distorted by Bolsonaro groups, who claim that the resolution promotes abortion among children and adolescents.
After approval of the text, the Ministry of Human Rights and Citizenship published a note in which it said that the opinion of the body’s legal consultancy indicated that the resolution presented definitions that could only be set out in laws. The ministry also informed that all government representatives voted against the Conanda rule.
“This divergence between the Government and civil society at Conanda does not usually occur when approving resolutions”, says Ariel de Castro, former president of the body. “This lack of harmony could end up weakening the regulations that were approved, which is already being challenged by conservative sectors and the evangelical group in congress.”
For him, the government’s stance should encourage sectors opposed to the resolution, such as conservative politicians, to take legal action to try to suspend the rule. “And they will use this lack of consensus and divergence from the government as justification.”
“This publicizing of antagonism on Conanda via note did not occur even during the previous government, Bolsonaro’s,” he adds.
The president of Conanda, Marina de Pol Poniwas, states that the resolution’s theme is not new to the council. “Since September, Conanda has been producing the draft resolution, approved today, which seeks to protect children and adolescents.”
She states that the council has been holding meetings and made the draft available for collective construction among all councilors. “We reinforce that all internal procedures were followed rigorously, respecting Conanda’s internal regulations, demonstrating the legitimacy of the resolution, which seeks to detail a matter already provided for in Law, establishing procedures to guarantee full protection.”
