The federal government published a decree with rules that regulate the use of force by police officers. The text from the Ministry of Justice and Public Security was published in the Official Gazette of the Union (DOU) this Tuesday (24). One of the points discussed is the creation of a National Committee for Monitoring the Use of Force.

According to the text, the use of a firearm should be used as a last resort and should not occur in two situations: when the person fleeing is unarmed or against a vehicle that fails to respect the police block on a public road. In both cases, use will be permitted when there is a risk to public security professionals or third parties.
The use of force is authorized when other resources are not sufficient and the level of force used is of the same intensity as the threat presented by the person involved.
The text also contains information on regulations on the use of handcuffs, the need for planning major operations and the creation of a National Committee for Monitoring the Use of Force.
Regarding penalties, the decree also provides for liability for security agents who inappropriately use force. Furthermore, public security professionals must act in a non-discriminatory manner, without prejudice based on race, ethnicity, color, gender, sexual orientation, language, religion, nationality, social origin, disability, economic situation, political opinion or any other nature.

The decree provides guidance on the creation of the National Committee for Monitoring the Use of Force, which aims to guarantee transparency and public access to data on the topic.
In this way, reports will be produced that contain analysis and guidance on the use of force, such as numbers of deaths caused by police officers and deaths of police officers. The decree also guarantees the participation of civil society representatives in the Committee.
Training
Training of agents must occur annually with the adoption of content that addresses procedures on the proper use of different types of firearms and instruments with less offensive potential.

Decree brings updates
The new rule on the use of police force updates a previous ordinance from the Ministry of Justice that has been in force since 2010.
The guidelines will not be imposed on the states and the Federal District, which command the Military Police, Civil Police and Criminal Police. The Minister of State for Justice and Public Security will also add additional standards necessary to implement the text in practice.
