The former federal deputy Daniel Silveira (no party-RJ) . On Sunday (22), he arrived home at 2:10 am, contrary to his decision to go to bed until 10 pm and only leave after 6 am.
The defense justified the delay with a trip to the hospital, but the time of medical discharge and the average travel time to the residence indicate a possible violation of the rules.
The newspaper The State of S. Paulo analyzed the times shown in the hospital documentation presented by his own defense and the travel times through streets and avenues in Petrópolis (RJ) indicated in traffic applications.

Asked about the contradiction, the former deputy’s lawyer states that, after being released by doctors, Daniel Silveira was still under observation for around an hour. One of the tests carried out by the former deputy registered a rate above normal, which led the doctor to suggest follow-up with a kidney specialist.
“I declare for all due purposes that the patient Daniel Lucio da Silveira was receiving care from 10:59 pm on 12/21/2024 [sábado] at 00:34 on 12/22/2024 [domingo]”, says the attendance certificate signed by doctor Gabriel Moreira do Nascimento Costa. The document is attached to the process by Daniel Silveira’s lawyers.
The 16.4 kilometer journey between Hospital Santa Teresa and Daniel Silveira’s house, in Petrópolis (RJ), can be done in 22 to 30 minutes, according to Google Maps. Despite the conclusion of the service shortly after half past midnight, he only arrived home at 2:10 am, taking about three times longer than expected. The time was indicated by the system that monitors the electronic ankle bracelet.

According to medical documentation, Silveira began to be treated at Hospital Santa Teresa with “lumbar pain radiating to the flank (sides of the abdomen) and a history of kidney failure”. He performed blood and urine tests, with samples collected at 11:42 p.m.
The former deputy was advised to consult a specialist under CID N18, referring to chronic renal failure, and released with the recommendation to increase water consumption. The documents were presented by the politician’s defense to prove the search for medical care on Saturday.
O Estadão questioned the former deputy’s defense regarding the interval between leaving the hospital and arriving home. By telephone, lawyer Michael Robert Silva Pinheiro, one of the four responsible for the defense, explained that Silveira remained in the hospital for around an hour after the recorded discharge time. According to him, the stay was necessary for observation due to the medication administered.

Pinheiro informed that he has already requested images from the hospital’s security cameras to prove that the departure took place after 1 am. The lawyer also stated that the doctors who treated the former deputy will confirm his version and that they were called to testify by Minister Alexandre de Moraes.
The Minister of the Federal Supreme Court (STF) Alexandre de Moraes stated, in his decision, that Silveira should have previously requested authorization to go to the hospital during curfew hours, which did not happen. Furthermore, Moraes concluded that the urgency that would justify leaving the hospital after 10pm was not proven, even after the treatment.
As a result, the minister considered that the former deputy violated the conditions of his probation. The magistrate revoked the benefit granted to Silveira on Friday (20, and ordered his immediate arrest. The former parliamentarian was taken to the Bangu 8 prison, in the Gericinó Complex, in the west zone of Rio. In the decision, Moraes highlighted that the infraction occurred on the first day that Silveira enjoyed the benefit, obtained after serving one third of the sentence of eight years and nine months.

In a statement, Daniel Silveira’s defense stated that they received the news of the revocation of his parole with surprise. The lawyers also stated that, to date, they have not had access to allegations of non-compliance with precautionary measures by the former deputy.
“The precautionary measures imposed by the minister were not violated” says the text. “After leaving the agricultural colony, Mr. Daniel went straight to his home in Petrópolis, only leaving to go to the hospital, as he was suffering from severe back pain which, after examinations, confirmed a health problem with his kidneys.”
The defense awaits the custody hearing, scheduled, according to lawyers, to take place by the 26th.

In April 2022, the Supreme Court sentenced Daniel Silveira to 8 years and 9 months in prison for threats to the Democratic Rule of Law and coercion during the process. The majority of ministers considered that their statements went beyond parliamentary immunity and freedom of expression, constituting serious crimes.
Rapporteur of the action, minister Alexandre de Moraes highlighted that the threats included incitement to violence against STF ministers and defense of a new AI-5, widely publicized on social networks.
