The São Paulo Penitentiary Administration Secretariat announced that, during the Christmas and New Year holiday period, 31,856 prisoners were allowed to leave temporarily. This departure began on December 23rd and will last until January 3rd. Among the released inmates are names such as Lindemberg Alves, who is serving 39 years for the murder of his ex-girlfriend Eloá — who was 15 years old at the time —, and Cristian Cravinhos, sentenced to 38 years for the double murder of Suzane von Richthofen’s parents.
The benefit of temporary release is granted by the Judiciary and applies to inmates who are in a semi-open regime. The Secretariat made an important warning: if a detainee does not return at the end of the period, he will be considered a fugitive, which will result in the loss of the benefit and the return to the closed regime.
Recently, the National Council of Justice (CNJ) declared an ordinance of the São Paulo Court of Justice illegal. This rule allowed the arrest of inmates who did not follow the rules during their temporary release. The CNJ clarified that the police can only arrest a beneficiary if there is a flagrant crime. In different situations, the detainee who fails to comply with the rules must be released after registering a police report.
