STF files Michelle Bolsonaro’s lawsuit against Erika Hilton

The Federal Supreme Court (STF) rejected the former first lady’s criminal complaint Michelle Bolsonaro (PL) against the deputy Erika Hilton (PSOL-SP).

The lawsuit accused Hilton of libel and defamation following a post on social media. The 1st Panel of the STF archived the case, which has now become final and unappealable, ending the possibilities of appeal.

The process was motivated by a comment made by the deputy, made in March, against the granting of the title of São Paulo citizen to Michelle Bolsonaro. At the time, Hilton wrote: “We can’t even pay homage to Michelle Bolsonaro for never disappearing with another family’s dog because she literally did that already.”

The statement made reference to an episode that occurred in 2020, when the Bolsonaro family adopted a dog found at the Palácio da Alvorada. The animal was later identified as belonging to another family and returned to its owner.

Michelle filed the complaint in August and asked for compensation of R$15,000, alleging that Erika Hilton had insinuated bad faith on her part. The former first lady appealed after the minister’s monocratic decision Luiz Fuxfrom the STF, handed down in October, which rejected the criminal complaint based on parliamentary immunity.

For Fux, immunity is “unequivocal” in this case, protecting deputies and senators for opinions during the exercise of their mandate.

After Fux’s denial, Michelle’s defense sought reconsideration, but the appeal was denied by the 1st Panel, composed of ministers Alexandre de Moraes, Cármen Lúcia, Luiz Fux, Cristiano Zanin and Flávio Dino.
