The (Supreme Federal Court) rejected a criminal complaint by the former first lady against the federal deputy (-SP).
Michelle sued the court after the parliamentarian’s publication on . The former first lady asked for R$15,000 in compensation.
The comment occurred last March, when Erika spoke out against the granting of the title of São Paulo citizen granted to Michelle. The deputy cited the case of the dog. The animal already had a guardian, to whom it was returned.
The case’s rapporteur, the minister initially denied the request when he assessed that the PSOL representative’s statements were protected by parliamentary immunity.
Michelle appealed, and the court upheld Fux’s decision, understanding that Erika’s publication had a “clear” political character, “aimed at reinforcing her parliamentary role as a representative of the voters of São Paulo and in opposition to the current mayor of the capital of São Paulo, thus highlighting the scenario of political/ideological antagonism that served as the stage for such publication”.
