Councilors Amanda Paschoal (PSOL) and Nabil Bonduki (PT), who take office on January 1st at the São Paulo City Council, took legal action questioning the meeting of the CMTT (Municipal Traffic and Transport Council) that.

In the action, they state that the project should be conducted with transparency and guaranteed social participation, especially by the CMTT. Paschoal and Bonduki argue that the meeting was called hastily, between Christmas and New Year, and failed to comply with court orders on the need to guarantee social participation in the deliberations.
They also say that the technicians did not know how to justify a series of information, such as what would be the motivation for choosing between the value of R$5 or R$5.20.
“The absence of broader public consultations, of sufficient time to publicize the meeting and its theme, and the disrespect for the council’s deliberations affect the legitimacy of the measure and violate the right to democratic management, also provided for in the National Urban Mobility Policy law. “
“The tariff increase must be justified for technical and economic reasons and take into account social impacts, without disproportionately burdening the population, especially in a context of worsening social inequalities”, they write, in the action. “Similarly, this increase must be preceded by rigorous formal procedures, both in terms of technical studies and broad social participation, something that was not guaranteed in this specific case.”
The action indicates that the increase without analyzing the impact on vulnerable populations, without the necessary transparency and assessment by the CMTT “constitutes a violation of several constitutional and infra-constitutional rights, in addition to contradicting the laws that govern urban mobility and the provision of public services .”
“Ricardo Nunes increasing the fare to R$5 reais will greatly harm the population of São Paulo”, says Paschoal. “It may seem small to talk about R$0.60 per ticket, but for those who work and use it all month long, this comes to R$26. It’s one less meal for those who have money.”
Bonduki, in turn, states that City Hall did not respond to several problems involving the calculation of the increase.
