The decree published on Monday (23) states that operations need to be planned to minimize the use of force and avoid damage. The action must be “compatible with the severity of the threat” faced by the agents, be within the law and be guided by “common sense, prudence and balance”. If a police officer can’t follow the law or common sense, maybe he shouldn’t carry a gun.
The following article restricts the use of firearms against unarmed fugitives or those who do not pose an immediate risk. The same goes for vehicles that disregard police roadblocks without posing any risks. The rule would not exist if some police officers did not shoot at random or decided to accept the death of innocent people as side effects of their actions.
Even though it only establishes what should be obvious, the decree has its problems. It fails, for example, to address situations in which agents could shoot to immobilize a suspect. Furthermore, it repeats rules that already exist or are part of police protocol. The novelty is to condition the transfer of federal funds to compliance with the measures, but there is no clear definition of criteria for this assessment.
Instead of criticizing the text’s defects, some governors took advantage of the episode to renew carte blanche on police brutality. From Rio, he turned to a specialty and tried to use the decree as another excuse for his incompetent management of public security. , from Goiás, stated that the text “ends up favoring crime”.
Caiado also said that the decree was a “Christmas gift” for organized crime. Nonsense. In practice, . Poorly packaged as it was, in fact, the text serves more as a gift for politicians who use panic marketing to mask their disregard for minimum civilizational standards.
