The governors (Novo-MG), Ratinho Júnior (PSD-PR), (Republicanos-SP) and (Republicanos-RJ) state that the government () that defines new rules for “benefits organized crime and, in practice, blocks the autonomy of the states, in a clear sign of violation of the Brazilian Constitution”.
In a note, the governors, who belong to Cosud (South and Southeast Integration Consortium), state that, with the document, “the federal government seeks to regulate the attribution of state police”.
“The measure is arbitrary and an unprecedented attempt to interfere in the states’ security policy”, they assess.
They ask that the decree be urgently revoked, as its content “punishes men and women who daily risk their lives for the benefit of society.”
Finally, the governors say that the safety of Brazilian families “will not be guaranteed with evasive decrees that limit the power of the police, but rather with coordinated investment and the tightening of laws.”
The note is signed by 4 of the 7 Cosud governors. Renato Casagrande (PSB-ES) and Jorginho Mello (-SC) did not want to join, and Eduardo Leite (PSDB-RS) is still evaluating the document with his legal team.
Leite, although he did not sign the document with his colleagues, sent a statement to the Panel in which he also criticized Lula’s decree.
“The bias of the approach, with the force to contain police action (to avoid arbitrary actions by those acting on behalf of the State, which is justified), but without demonstrating the same ‘appetite’ in confronting criminals, demonstrates that they still do not understand the size of the problem that Brazil has to face”, said the gaucho.
He says he is particularly bothered by the way the decree was announced, without dialogue with the states. “Issuing a decree of this nature without dialoguing with the Security Secretariats and governors is a big mistake”, he states.
One of the main points of the new rule presented by the PT government provides that it is not legitimate to use a firearm in two circumstances: against a person on the run who is unarmed or who does not pose an immediate risk of death or injury to police officers or third parties; and against a vehicle that fails to respect a police blockade on public roads, except when there is a risk of death or injury.
The text says that public security professionals must prioritize “communication, negotiation and the use of techniques that prevent an escalation of violence.” The focus, according to the decree, is to minimize the use of means that may cause offense, injury or death.
