Agency speaks of lack of “technical basis” for suspending the proposal requested by the Brazilian Association of Health Plans

The (National Supplementary Health Agency) reported on Sunday (Dec 29, 2024) that it will maintain the public consultation that could result in changes in the sector, such as allowing health plans to make more than one adjustment per year to their customers .

“The National Supplementary Health Agency (ANS) informs that there is no technical basis for suspending the ongoing public consultation and that it will continue within current regulations and legality”the agency said in a note.

The statement comes after the of the (Brazilian Association of Health Plans) so that the be suspended. The consultation will collect information on proposals related to price policies and adjustments until February 3rd.

It covers 4 thematic axes:

  • adjustments and contractual termination in collective plans;
  • financial regulation mechanisms;
  • selling health plans online;
  • technical review of tariffs.

In the letter sent to the regulatory agency, Abramge states that the ANS regulatory change proposal is very sensitive for the market. Here’s the of the letter (PDF – 183 kB).

The assessment of health plan operators is that more time is needed to analyze the economic impacts of all aspects of the public consultation. It also says that the deadlines for contributions are short.

A (National Supplementary Health Federation) sent a letter to ANS asking the agency to extend the deadline for contributions to at least 90 days. Here’s the (PDF – 194 kB).

The issue of technical review of tariffs is the most controversial topic, and one that can directly affect the pockets of health plan users.

As o Poder360the ANS proposal is to institute an extra charge to help companies that operate collective and individual plans that are in proven financial difficulty. Here’s the of the draft dealing with the new charge (PDF – 537 kB).

In this way, some companies could benefit from an additional adjustment, beyond what is currently permitted – an annual adjustment based on inflation. The draft does not give details of how the calculation for this extra charge would be.
