CNJ maintains secrecy on Minas judge’s trial – 12/30/2024 – Frederico Vasconcelos

The CNJ (National Council of Justice) maintained the secrecy of the disciplinary process against judge Alexandre Victor de Carvalho, of the Court of Justice of Minas Gerais,.

Due to the seriousness of the facts, the sentence was considered a reward, two 60-day vacations.

By making the procedure unavailable, the CNJ prevents citizens from knowing details of the virtual sessions.

The board accompanied the rapporteur, Daniela Madeira.

When consulted, the CNJ cited Resolution 135/2011:

The judgment of the disciplinary administrative process will be carried out in a public session and all decisions, including interlocutory ones, will be justified.

(…)

In certain procedural and trial acts, the presence may, however, be limited to the parties themselves and their lawyers, or only to them, as long as the preservation of privacy does not harm the public interest. (emphasis added)

What intimacy will be preserved? Alexandre violated the Organic Law of the National Judiciary and the Code of Ethics. Colleagues say he does not maintain the sobriety of a judge.

He the appointment of his wife and son (he tried to include his mother-in-law) to “phantom” public positions, without payment for services. Salaries would be “split”.

The STJ (Superior Court of Justice) rejected a complaint against Alexandre for passive corruption. Evidence was shared with the CNJ. On April 22, 2021, lawyer Eugênio Aragão tried to interrupt the vote of rapporteur Herman Benjamin.

Aragão alleged a fortuitous meeting of “conversation between friends, talking about pleasantries”.

The dialogues reveal the choice of a judge.

Alexandre is the son of , former president of TJ-MG, suspected of corruption. Before retiring, a lawyer who would receive earnings without working was convicted in the TJ-MG, accused of extorting the former president. The son, suspected of “cracking” her salary, was acquitted.

The CNJ’s rigor with other judges would not affect the Carvalho family, defended by two former Ministers of Justice: Eugênio Aragão and Alexandre de Moraes.
