The deputy’s defense asked for “humane” house arrest because of his health condition
The (Attorney General’s Office) spoke out against the deputy’s defense request (no party-RJ) for the prisoner’s transfer to house arrest “humanitarian”. The lawyers claimed that Chiquinho would need to undergo surgery due to heart problems and asked the (Supreme Federal Court) to replace the preventive detention.
After the defense’s request, STF Minister Alexandre de Moraes asked the Campo Grande Federal Penitentiary to provide information about the health status of the deputy, who is a defendant in court for alleged involvement in the murder of the councilwoman (Psol), in 2018.
Among the information requested by Moraes was a medical evaluation, which was scheduled to be carried out last Friday (Dec 27). With the delivery of the data, Moraes ordered that the files be sent to the PGR for a statement from the agency.
This Wednesday (January 1, 2025), the PGR opinion, signed by the deputy attorney general of the Republic, Hindenburgo Chateaubriand Filho, says he is against changing the regime “because there is no situation of physical weakness that would recommend it”.
According to the document, the medical evaluation carried out on December 27 concluded that Chiquinho would be clinically stable, but would need to undergo an in-person medical evaluation to assess his condition. In this way, the PGR wishes to allow face-to-face consultation with a cardiologist in the penitentiary unit.
“Thus, even though it is not disputed that the custodian has suffered from chronic cardiopathologies for over 17 years, with the potential for progression to more serious conditions, none of them attests, peremptorily, to the need for surgical intervention, but only the recommendation for consultation. face-to-face to evaluate the measures that your current health status requires”he states.
The PGR also states that Chiquinho’s health is being monitored by the penitentiary where he is being held. According to the agency, 37 consultations and medical care were provided from March to December 2024.
“It obviously does not mean proposing that you wait for your clinical condition to worsen before adopting the relevant procedures. If carrying out additional tests, which are still to be evaluated, can, at this moment, anticipate the need for possible surgical intervention, this is an act that must be authorized, under the care of the penitentiary administration.”writes the PGR.
