Lula sees MP approval rate drop to 14%

The President had difficulty getting support in Congress for provisional measures; rate 20 years ago had been 93%

The current government of the president (PT) will maintain for the 2nd year a low approval rate for the MPs (provisional measures) sent to Congress. The PT member managed to transform into law only 9% of the measures issued this year. In 2023, the index had been 21%.

It must be considered, however, that there are 29 MPs being processed in Congress and that they can be approved from February onwards, when deputies and senators will return to their activities. The tendency is for the utilization rate to rise.

Lula issued 133 provisional measures in the first 2 years of his 3rd term. Of these, 19 were turned into law by Congress, a conversion rate of 14%.

The tactic of sending MPs to Congress was publicly resisted by the president of the Senate (PSD-MG). In an unusual act in June, the senator returned the compensation MP () as he considered it unconstitutional. At the time, Congress sent a message to Planalto that the imposition of provisional measures would not have the same reception as in previous years, an indication of the accumulation of power of congressmen in the face of a weakening of the Presidency of the Republic.

WHAT ARE PROVISIONAL MEASURES

Provisional measures are an instrument used by the government to determine standards immediately. They have the force of law, that is, they become valid as soon as they are published in the DOU (Official Gazette of the Union).

They are used in situations of relevance and urgency, such as emergency release of resources, exemption from bidding, temporary reduction of rates and rules for new programs.

However, to become a definitive law, these texts need the approval of the National Congress, which has up to 120 days to analyze them. After this period, they lose their validity and their processing will be closed if they have not been voted on.

GOVERNMENT DIFFICULTIES

The government has had difficulty directly approving the provisional measures it publishes. Of the 133 MPs from the 3rd Lula administration, 73 lost their validity without being approved by deputies and senators (55%).
