The Military Justice sent to the (Supreme Federal Court) an investigation targeting four Army colonels on suspicion of involvement in the preparation of with the aim of pressuring the Force command to embark on the coup against the election of ().
The case reached the first instance of the Federal Military Court after the closure of the IPM (military police investigation) initiated by the Army.
According to a note released this Monday (6) by the Military Justice, “it was found that the officers participated in the authorship and review of the document, which consisted, in short, of a public criticism of authorities and institutions, especially the Commander of the Brazilian Army “.
“The text dealt with topics related to military discipline, without superior approval, and constituted incitement to disobedience and indiscipline.”
Responsible for the case, judge Alexandre Quintas, from the 2nd Military Audit of Brasília, highlighted that the circumstances discovered in the IPM were connected to the facts investigated by the Federal Police in the context of the undemocratic acts of January 8, 2023.
Furthermore, three of those investigated appear on the list of those indicted by the PF for the crimes of violent abolition of the Democratic Rule of Law, attempted coup d’état and criminal organization.
Quintas cited in his decision the understanding of the STF, which established its jurisdiction to prosecute and judge crimes related to the acts of January 8, 2023, regardless of whether those investigated were civilians or military personnel, from the Armed Forces or state police.
“There is, therefore, no competence of the Union’s Military Justice to prosecute and judge military personnel from the Armed Forces or States for committing crimes that occurred on 1/8/2023, notably those provided for in the Penal Code, such as terrorist acts, threats, persecution, damage , incitement to crime, arson, armed criminal association, violent abolition of the Democratic Rule of Law and coup d’état, all under consideration by this Federal Supreme Court”, recorded the judge.
