The (Supreme Federal Court) has already sentenced 375 defendants in 2023, which resulted in the indictment of 1682 people involved.

In total, according to the PGR (Attorney General’s Office), more than 900 people were held responsible, including those who signed an agreement with the Court.

Most of the invaders were convicted of five crimes: armed criminal association, violent abolition of the democratic rule of law, attempted coup d’état, qualified damage and deterioration of listed property.

In total, 155 defendants are in prison. According to information from the STF, 78 provisionally, 70 definitively, and 7 are under house arrest. To date, only four have been acquitted.

In addition to these, 527 defendants chose to sign non-criminal prosecution agreements. Through this instrument, those responsible for less serious crimes can have their criminal case closed without conviction, as long as they comply with alternative measures.

These measures include providing 150 hours of community service and participating in a course on democracy. During this period, the defendants have their passports and weapons license suspended and cannot use social media. After full compliance, they maintain the status of first-time offenders.

According to information from the STF, the court has 1,093 cases of simple crimes linked to January 8, of which it judged 147, and 459 of serious crimes, of which 228 were judged.

In total, there are 1,552 criminal actions underway.

Investigations and criminal actions are carried out under the report of the minister. The decisions were taken by the First Panel unanimously and by a majority in the plenary, defeating the ministers and .

Among the 1,682 denounced, 1,204 were inciters, 407 were executors, 63 were financiers, and there are also 8 authorities, according to the division made by the MPF.

Each defendant is judged individually by the STF, in most cases in the virtual plenary, a remote environment through which ministers include votes and there is no discussion between them regarding the topics analyzed.

Among the executors, most were sentenced to 3 to 17 years in prison, in addition to a fine and compensation for collective moral damages of R$30 million. The amount corresponds to the material damage caused, in addition to damage to cultural and historical assets, and must be shared by all those convicted.

The MPF called for the conviction of seven members of the Federal District’s Military Police leadership on the date of the invasions. Investigations into financiers and other authorities involved in the case are still ongoing.

8/1 Two Year Act

The two-year anniversary of the attacks will be held in , followed by an act involving left-wing militants in Praça dos Três Poderes.

According to Secom (Secretariat of Social Communication of the Presidency), the president () will participate in the presentation of works of art that had been vandalized — and have now been restored — and in a ceremony with authorities at Palácio do Planalto. The presidents of the Powers and governors were invited.

Right-wing parliamentarians pressured members of centrist parties not to attend the event last year. The president of the Chamber, (-AL), did not attend. This year, despite the invitation, he is not yet confirmed, as is (PSD-MG), president of .

The event in Planalto that marks two years since the attacks will take place less than a month before the elections for the leadership of Congress. The likely successors of Lira and Pacheco, (Republicanos-PB) and (-AP), respectively, were also invited, according to reports.

In , there is a bill that provides for amnesty for those arrested in the coup acts. Lira had promised to vote on the project during her administration, which did not happen.
