SP court orders Metrô to compensate woman who broke her leg while boarding

The Justice of São Paulo ordered the Metro to compensate a passenger who fractured her femur in an accident while boarding at a station. The case took place in 2022 and the decision was made by the 12th Chamber of Public Law of the Court of Justice of São Paulo.

According to the records, the passenger was injured after being pressed by the . The value of compensation for moral damages was set at R$ 20 thousand.

During the trial of the action, for the rapporteur, Judge Souza Nery, the images demonstrated the absence of adequate signs to warn about the closing of the doors, such as flashing lights, which directly contributed to the accident.

In his vote, the judge pointed out that the company must respond for the harmful event, since it did not prove the victim’s exclusive fault.

The decision was made by majority vote.

When contacted, Metrô stated in a note that “appealed the decision, reinforcing the security of its system in favor of the passenger, as well as the correct functioning of the equipment and methods when the incident occurred.”
