The Federal Public Ministry () established a deadline of 30 days for Meta to provide clarifications on the new content moderation guidelines that were announced by us. The objective of the MPF is to understand how these changes will affect Brazilian users, including the implementation date and specific details of the changes. Last Tuesday (7), Zuckerberg revealed that Meta will discontinue the fact-checking program, replacing it with a new system like “Community Notes”, from X.

The MPF’s request is linked to an ongoing 2021 civil inquiry investigating the responsibility of large technology companies in relation to content that is published on their platforms. The MPF requested detailed information on how these changes will be applied in Brazil. Among the questions raised are the date on which Meta will end its partnership with checking agencies, how many of them will no longer act in content moderation and what types of violations will be considered “serious”. Furthermore, the agency asked about the restrictions that will be removed on sensitive topics, such as immigration and gender.

Prosecutor Yuri Corrêa da Luz highlighted in the document that there is already legislation in Brazil that imposes obligations on service providers to guarantee the protection of citizens’ fundamental rights. He also warned that adopting an almost non-existent moderation policy could result in civil liability for Meta if users’ rights are compromised.
