Francisco Cuenca, prosecutor at the La Pampa Public Ministry, which is investigating the accident involving Rodrigo Garro, from Corinthians, released new information about the case. According to Cuenca, forensic experts verified a concentration of 1.5g/L of alcohol in the blood of the victim, Nicolas Chiaraviglio, aged 30. He also tested positive for marijuana and cocaine.

“These results suggest that Chiaraviglio’s state of intoxication may have influenced the fatal accident, although work is still ongoing to reconstruct the event,” Cuenca told the En Boca de Todos HD portal, from the province of La Pampa, in Argentina.

Furthermore, Cuenca said that the Municipal Traffic Department found that Chiaraviglio was riding with a driver’s license that expired in September 2022. The motorcycle’s lighting system, the impact between the vehicles and the speed at which they were traveling are still being examined. Sources linked to Garro’s defense say that the motorcycle had its headlights off, that the victim was not wearing a helmet and that the location did not have adequate signage or lighting. Garro helped the motorcyclist.

According to Cuenca, eyewitnesses to the accident have been identified and will be called to testify. “There are people who attended Chiaraviglio at the scene of the accident and we are working with them to obtain more details that will help clarify how everything happened,” explained Cuenca.

On January 4, when the accident occurred, Garro was traveling in a Dodge RAM truck along 300th Street, in his hometown, General Pico, where he was on vacation. At the intersection with 108th Street, the vehicle was hit by the Motomel 110 cc driven by Chiaraviglio.

The Corinthian was detained to give a statement and then released. The midfielder underwent a blood alcohol test which found the presence of 0.54g of alcohol in his blood. The player was charged with manslaughter without intent to kill.

The Argentine was subject to article 84, which deals with reckless and negligent driving at the wheel. He is banned from driving, but there was no aggravating factor in the indictment, which allowed him to return to Brazil for the Corinthians squad reunion on Tuesday.

After investigations, the Prosecutor’s Office decides whether to pursue the complaint. After that, a judge will decide whether to take Garro to trial, in a process that should last 1 to 2 years.

Since the first information about the accident began to circulate, Corinthians set up a group to monitor the case. The legal director, Vinicius Cascone, and the football executive, Fabinho Soldado, maintain contact with Garro’s lawyers. The club will not comment on the information revealed by prosecutor Francisco Cuenca this Thursday (9).
