The STF minister suspended visits to Rodrigo Bezerra after his sister tried to enter with equipment hidden in panettone
Rodrigo Bezerra de Azevedo’s defense asked again on Thursday (January 9, 2025) that the minister of the (Supreme Federal Court) Alexandre de Moraes authorize the soldier to receive visits, which since December 30th by decision of the magistrate. The ban came after Bezerra’s sister tried to enter the place where he is being held with equipment hidden in a panettone box.
Bezerra is in prison for alleged involvement in a coup plot and assassination of the president (PT). In the petition, the defense states that the restriction only “it would be legitimate” if there was proof of the military’s direct involvement or if a risk was found “evident to the security of the prison establishment”. In , the defense argued that Bezerra had no knowledge of Dhebora’s attempt to enter the place with the objects. The lawyers also argued again that restricting visits would violate the principle of individualization of punishment, which prohibits the application of sanctions to third parties.
“Furthermore, it is imperative to highlight that other family members, duly authorized to carry out visits, have a legitimate interest in maintaining emotional ties with the person in custody. This interaction plays an essential role in the process of resocialization of Rodrigo Bezerra de Azevedo, which is being prohibited by a decision that imposes sanctions on third parties unrelated to the facts committed, thus violating the legal provisions mentioned.”says the document.
Therefore, the possibility is suggested that other family members, not involved in the case, carry out visits, “especially the petitioner’s wife and daughter, remotely, by video conference”. If the request is denied, the defense states that family members are willing to give up their right to privacy during visits.
According to information from the Planalto Military Command sent to the Supreme Court, Dhebora made the visit on December 28, around 2:15 pm, and took a sealed box of panettone to be delivered to his brother.
When carrying out the item verification procedures, the panettone passed through the metal detector, which beeped. Afterwards, after being approached by the PIC (Criminal Investigations Squad), she stated that there was a phone inside the box.
When opening the box, in addition to the phone, a USB cable and a memory card were found. The material was then kept in custody at the PIC and Dhebora was prevented from visiting Rodrigo.
Moraes then ordered that any visitation to the military be suspended and sent a copy of the order to , so that it could take action. “appropriate measures”.
