The compensatory provision of holiday and Christmas bonuses is financial support created to protect workers who, due to illness or parenthood, did not receive, partially or completely, the benefits to which they were entitled. This mechanism aims to ensure that workers do not face significant financial losses in situations of prolonged, duly justified absence.

The support is intended for salaried workers and business managers or administrators (MOE’s), as long as they demonstrate that they are entitled to the subsidies and meet the necessary requirements. In the event of the death of the beneficiary, family members who are entitled to death assistance may, within the legal period, request the compensatory benefit, if the worker has not done so. However, this support excludes self-employed workers, beneficiaries of voluntary social insurance and people covered by occupational illness leave.

In situations of illness, it is necessary that the worker is receiving sickness benefit, that the absence lasts 30 consecutive days or more and that the missing benefits have not been paid by the employer, in accordance with the CLT. In cases of parenthood, it is required that the worker has been on parental leave with benefits and without access to holiday and Christmas benefits, also for a minimum period of 30 days.

According to , the value of the installment depends on the situation. In cases of illness, support corresponds to 60% of the value of unpaid aid, while, in cases of parenthood, it is 80%. For assistance to children with disabilities or chronic illnesses, the maximum amount is 1,045.00 euros (equivalent to twice the IAS).

The request can be made online on the Social Security Direct platform or in person. It is necessary to present supporting documentation, such as statements from the employer and IBAN. The deadline for requesting the benefit is six months, counting from the beginning of the year following the year in which you are entitled to the benefit or the termination of the employment contract. Payment is made by bank transfer or postal order.
