The Minister of the (STF) issued an order for the former federal deputy to deliver a document registered in his name within 48 hours. This period starts from the moment Silveira’s lawyers are notified. The pistol in question is a 38 caliber Taurus, the possession of which was confirmed to the STF by the Army Command, responsible for registering firearms in Brazil. It is important to highlight that Silveira is not registered as a collector, shooter or hunter, and the weapon is registered in the Military Weapons Management System, the Army’s database.
The Brazilian Army clarified that its competence in the Military Weapons Management System (Sigma) is limited to maintaining the record of firearms ownership, and cannot take administrative measures in the case. Responsibility for managing firearms possession of members of the state military police lies with the respective corporation. In the case of Daniel Silveira, the Rio de Janeiro Military Police is responsible for ensuring compliance with the court decision prohibiting possession of the weapon.
The STF is awaiting a response from Silveira’s defense regarding the handover of the weapon to the judiciary. Daniel Silveira was sentenced to 8 years and 9 months in prison for inciting anti-democratic acts, threatening institutions and apologizing for the military dictatorship. Despite having obtained provisional release at the end of last year, he was arrested again after failing to comply with precautionary measures imposed by the STF.
