Flávio Bolsonaro sues Haddad in court over “rachadinha”

Senator requests payment of R$60,000 for moral damages; minister criticized him when announcing the revocation of Pix monitoring

The senator (PL-RJ) filed a lawsuit with the TJDFT (Court of Justice of the Federal District and Territories) this Thursday (Jan. 16, 2025) against the Minister of Finance, for claims made to the congressman in the case of “cracks”.

In the action, Flávio requests compensation for moral damages in the amount of 40 minimum wages (R$60,720) and payment of court costs. He still requests a conciliation hearing with the minister.

He argued that Haddad’s statements, made publicly, are “false and unfounded” and reached their “right to honor, image and reputation”causing moral damage.

When announcing the rule that increased supervision over transfers above R$5,000 from Pix to individuals, minister Fernando Haddad cited the senator. He said that the State fought the scheme of embezzling the salaries of advisors linked to it because “identified an absurd movement” in your accounts.

“Now Flávio Bolsonaro is complaining about the IRS. He cannot complain to the Revenue, he was caught by the Revenue. The Bolsonaro family was one of the biggest critics of the monitoring of Pix transactions by the Tax Authorities. The senator stated that people who received transfers above R$5,000 would be monitored and could receive a charge from the Federal Revenue Service.

The former president (PL) also said that monitoring financial transactions made via instant payment or credit card “they would not exist in your government”.

The changes, in fact, would create a magnifying glass for transactions using digital payment methods – which would not imply a tax charge. The idea was to increase supervision and facilitate the identification of those who do not pay taxes.

In defeat after the negative repercussion, the Government backed down and revoked the measure. He blamed misinformation and scams in recent days to justify the drop.

CASE OF THE “RACHADINHAS”

Flávio was indicted in November 2020 for the crimes of criminal organization, money laundering, embezzlement and embezzlement (use of public money for personal purposes).

The investigation looked at transfers of salaries from employees of Flávio’s former office at Alerj (Rio de Janeiro Legislative Assembly) to former advisor Fabrício Queiroz, a practice popularly known as “rachadinha”.

According to the complaint, Flávio was the leader of a criminal organization that embezzled R$6 million from the coffers of Alerj (Rio de Janeiro Legislative Assembly), by hiring employees who shared their salaries in part or in full with the former advisor. Fabrício Queiroz, appointed as the scheme’s financial operator.

The MP-RJ investigation was opened in 2018, after a report from Coaf (Financial Activities Control Council) identified atypical movements of R$1.2 million in the bank accounts of former parliamentary advisor Fabrício Queiroz, who worked for Flávio at Alerj .
