The selection of the new legal representative is scheduled to take place on January 31st, as established by law. The term of office is three years, from 2025 to 2028.
Seeking re-election, Simonetti heads the only ticket in the dispute for command of the Federal Council. Lawyer Mário David Prado Sá requested registration of a separate candidacy, but was refused.
The Statute of the Order requires the registration of a complete ticket, under penalty of cancellation of the candidacy. In addition to the presidency, the ticket must have candidates for the vice-presidency, general secretary, deputy general secretary and treasury. The lawyer registered only his own name.
Furthermore, it is necessary to indicate the support of at least six sectional councils, which he also did not do.
HAS Sheet Prado Sá said it was difficult for those in the opposition to invite a counselor to form a ticket, “because they were co-opted by the presidency.” He used the same argument for the sectionals, from which he stated he was unable to seek support.

When questioned, the Order’s press office said that the accusations are false, that the rules for the elections were published in November and that the application for registration of the current president’s candidacy was made within the deadline.
The OAB board granted the request to register Simonetti’s ticket, making it the only valid ticket in the dispute. Even so, she will need to be elected by the majority of the plenary, made up of 81 federal councilors, three from each state and the Federal District.
