The DPU (Union Public Defender’s Office) requested that the (Attorney General’s Office) judicially question a law by Bento Gonçalves (RS) that provides for sanctions for beneficiaries who defraud social programs.
The body also sent letters requesting action to the CNDH (National Council for Human Rights) and the Attorney General’s Office of Rio Grande do Sul.
The law came into effect in the city of Rio Grande do Sul at the beginning of this year after the sanction of the re-elected mayor Diogo Siqueira (PSDB).
It establishes administrative sanctions, such as a fine of R$7,200, and incentives for the regularization of cases involving the use of false information in benefits such as .
“Although the law’s official justification is the promotion of social justice and transparency in the use of public resources, the DPU points out violations of the Federal Constitution, considering the rule as a risk for public income transfer policy”, says the body, in note.
The DPU requests that the PGR evaluate the possibility of presenting an ADPF (Argument of Non-compliance with Fundamental Precepts) to the Federal Supreme Court, with the argument that the law is unconstitutional.
It also asks the CNDH to analyze the possibility of adopting possible measures within the body’s responsibilities and the state Attorney General’s Office to evaluate a Direct Action of Unconstitutionality (ADI) with the Court of Justice.
