Bill allocates 30% of prisoners’ salaries to victims

Proposal being processed in the Chamber seeks to repair damages to victims with part of the inmates’ earnings from work activities

The Bill determines the allocation of at least 30% of the prisoner’s work remuneration to compensate for damages caused by the crime. According to the proposal, which is being analyzed at , the amount will be allocated to the victim or their dependents, and must be distributed proportionally if there is more than one victim.

Today, the law already establishes, among the destinations of the prisoner’s remuneration, compensation for damages caused by the crime, as long as they are determined judicially and not repaired by other means. However, it does not establish a minimum percentage for this allocation.

Author of the project, the deputy (PL-RJ) states that, in practice, there are rare cases in which part of the remuneration is actually intended for compensation for damages, which justifies bringing reparation to the victim or their family to the center of the debate.

“Repairing the damage caused by crime acts as an instrument that compensates for the losses faced and reaffirms the importance of the victim in the criminal process. This mechanism can help restore your dignity and support the reconstruction of your life or bring a minimum of encouragement and a feeling of justice”, says the parliamentarian. “Furthermore, a more transparent and responsible system is promoted, in which the impact of crime is recognized more broadly”he concludes.

PROCESSING

The project is underway in conclusive character and will be analyzed by the Constitution, Justice and Citizenship Commission. To become law, the measure must be approved by deputies and senators.
