Marcelo was “stuck” in the soil law (and it seems like no one noticed)

The President agreed to promulgate the diploma to “urgently” take advantage of the PRR – but, after all, no house will be built, the Prime Minister announced.

A soil law continues to give something to talk about. At the end of November, the Government issued a draft diploma that makes legislation on land use more flexible and simple, allowing Municipal Councils to unlock land for housing construction.

Practically a month later, the President of the Republic promulgated the diploma. But, as happens in other cases, it left repairs, this time on a “sprain”.

“Despite constituting a significant sprain in terms of a generic territorial ordering and planning regime, at national and local level, given the decisive intervention of municipal assemblies and the urgency in the use of European funds and in promoting housing construction, the President of the Republic promulgated the diploma”, indicated that of the Presidency.

In other words, despite the “sprain”, Marcelo understands that This law must be approved because it is “urgent” to use the money from the Recovery and Resilience Plan (PRR) to build houses in Portugal.

Last week, and taking advantage of this sequence, Mariana Mortongua asked Luís Montenegro how many PRR houses “will be built with this law and where”. It was a dialogue in the fortnightly debate in the Legislative Assembly.

The answer from prime minister you will be surprised: no houses will be built thanks to this new law. “In principle, based on the number of projects being considered and financed today, none.”

And he explained: money is already being used. “Because we are talking about projects that have already been presented, applied for and, therefore, have to be executed. If you ask me if anyone can change the location in the future, they can, as long as they comply with the rules, comply with the purposes and, above all, comply with the final purpose of this legislation”, replied Luís Montenegro.

“Land law is designed to guarantee transparency, to guarantee legality, to guarantee coherence and consolidation of urban areas, it is not created to stimulate speculation, it is not created for the ghosts that those who are always against transformations see whenever they want change something”, continued the prime minister.

The Left Bloc deputy reacted: “I note, therefore, that It is not to execute the PRR that this law is used. In fact, someone should inform the president of the Republic”.

Since the PRR money has apparently already been allocated, there is confusion regarding the reason that led to Marcelo’s decision.

“Well, I don’t understand… There was a problem in spending the money that has already been spent. Why was the law changed?“, asked João Miguel Tavares.

The commentator said that the President of the Republic was “stuck” with this situation: “That’s why you (Marcelo Rebelo de Sousa) are stuck. But he didn’t complain. And it seems like no one saw…”, he concluded.

The Assembly of the Republic will consider the Government’s decree to review the land law on the 24th – an initiative by the Left Bloc that had the support of the PCP, Livre and PAN. This after hearing the Ministers of Infrastructure and Cohesion, the National Association of Portuguese Municipalities (ANMP) and several experts, for clarification.

According to the newspaper, Marcelo will evaluate from scratch the decree that is announced after this parliamentary consideration. In other words, everything is open.
