Moraes sends Nunes’ justification to the PGR about the wall in Cracolândia

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), gave 15 days for the Attorney General’s Office (PGR) to comment on the response given by the City of São Paulo regarding the wall built in Cracolândia.

In response to the STF minister, the mayor of the municipality, Ricardo Nunes, stated that the construction of the wall was intended to prevent accidents, especially pedestrian collisions, and did not seek to segregate or restrict the right to come and go of homeless people.

The mayor argued that the area already had a metal fence in place for the same purpose, but that it began to be vandalized and broken by users who were grouped there.

According to the mayor, in addition to compromising the traffic of pedestrians, residents, commercial workers in the region and students from nearby schools.

“The hoardings were replaced because, as shown in the photographs, they did not present adequate resistance and were constantly damaged, broken into sharp parts, posing a risk of injury to people in vulnerable situations, residents and pedestrians, in addition to hindering circulation on the sidewalks”, states in the document.

Nunes also says that the structure was designed so as not to impede or impede access for health professionals, social assistance and humanitarian organizations, which provide essential services to the local population.

Moraes subpoena

Last Thursday (16), the STF minister, Alexandre de Moraes, ordered Nunes to explain the wall erected by the City Hall in the Cracolândia region.

The minister’s decision was taken within the scope of an action that is being processed in Court and concerns the guidelines of the National Policy for the Homeless Population. PSOL parliamentarians called for the construction to be torn down within a maximum period of 24 hours.

The parliamentarians argued that the wall isolates and socially excludes people living in Cracolândia and that the construction “commits a brutal and unconstitutional attack against the set of fundamental rights enshrined in the Federal Constitution, denying human dignity and violating basic principles of equality, freedom and access to essential rights.”
