Together, soldiers accused of killing Rubens Paiva earn R$140,000 per month

The soldiers accused of murdering former federal deputy Rubens Paiva receive, together, an amount of R$140 thousand per month. The amount relates to the pensions and salaries of five retired members of the Army. Per year, the amount paid by the federal government is R$ 1.682.903,00.

The retired major Jacy Ochsendorf e Souza receive just over R$23 thousand in gross salarywithout discount – which consists of alimony, health fund and income tax. The retired general José Antônio Nogueira Belham receive almost R$35.9 thousand per month of the federal government.

Defendants Rubens Paim Sampaio, Raymundo Ronaldo Campos and Jurandyr Ochsendorf e Souza died after the start of the process, but, in total, eight family members continue to receive pensions. Without discounts, the total value is R$80,000.

The soldiers Jacy Ochsendorf e Souza, José Antônio Nogueira Belham, Rubens Paim Sampaio, Raymundo Ronaldo Campos and Jurandyr Ochsendorf e Souza were denounced in 2014 by the Federal Public Ministry. Of the five accused, only two — Rubens and José Antônio — are alive.

In 2014, the Federal Public Ministry indicted the five for the crimes of qualified intentional homicide, concealment of a corpse, procedural fraud and armed gang. The complaint was accepted in the same year by the 4th Federal Criminal Court of Rio de Janeiro, and remained frozen until 2021, when it was sent to the Federal Supreme Court (STF).

The MPF even requested, in 2014, that the accused have their pensions or payments of any remuneration cancelled, in addition to establishing compensation to be paid to Rubens Paiva’s family by the suspects.

According to the complaint, the military had killed Paiva between January 21 and 22, 1971, on the premises of the Information Operations Detachment – ​​Internal Defense Operations Center, DOI-CODI, located in the capital of Rio de Janeiro.

The text cites the crimes of qualified intentional homicide, concealment of a corpse, procedural fraud and armed gang.

The murder of Rubens Paiva was committed for a base reasonconsisting of the search for the preservation of power usurped in 1964, through violence and use of the state apparatus to repress and eliminate opponents of the regime and guarantee the impunity for perpetrators of homicides, torture, kidnappings and body hiding“, says the document signed by the attorneys general.

Despite the complaint by the MPF, none of them were tried. In November 2024, Minister Alexandre de Moraes, of the Federal Supreme Court (STF), requested a statement from the Attorney General’s Office (PGR) – which has not yet responded. The PGR confirmed receipt of the action on November 27 last year. Now, the institution decides whether the case will be archived or whether it will be reported.

A former deputy, he was arrested and killed by the military dictatorship in 1971, in Rio de Janeiro. According to the report by the National Truth Commission, the politician was tortured in the Information Operations Detachment – ​​Internal Defense Operations Center (DOI-CODI) and died the day after his arrest.

In the official army version, he was kidnapped and reported missing. The death certificate was issued only after 25 years, in 1996, after a struggle by his wife, Eunice Paiva, played by Fernanda Torres.
