Action against Alcolumbre over jet skidding without data – 01/25/2025 – Power

An action opened against the senator (-AP) in the TRE (Regional Electoral Court) of Amapá for alleged abuse of economic power must be archived due to lack of information provided to the Court.

The case investigates whether Alcolumbre used two jets from the company Saúde Link, during his campaign in 2022, without declaring it in the electoral accounts.

The company, however, told the court that it does not have a list of passengers who flew on its aircraft during the period investigated. He further argued that private planes are not subject to documentation and passenger registration requirements established by Anac (National Civil Aviation Agency).

“For this reason, the requested information and documents cannot be presented, as he no longer holds and/or is in possession of them”, replied the company.

Alcolumbre is favorite to win the election for the presidency of the Senate, on February 1st. The Amapá parliamentarian already presided over the House from 2019 to 2020, when he began to accumulate political influence in Congress and in the distribution of parliamentary amendments, mainly for his state.

The investigation into the use of the planes was opened at the request of Rayssa Furlan (MDB), a candidate defeated by Alcolumbre in the 2022 election. She accused the parliamentarian of using the jets, without reporting in her expense statement, and asked for the revocation of her mandate. The senator denies his opponent’s accusations.

In the process, documents from the FAB (Brazilian Air Force) were attached, showing the routes of the aforementioned aircraft, between Macapá and Brasília, as well as landing and takeoff at the Hangar Comandante Salomão Alcolumbre airfield, which belongs to the senator’s family.

When contacted, Alcolumbre’s advisor stated that the senator did not use the aircraft mentioned in the process and that none of his parliamentary amendments were directed to Saúde Link.

The company was responsible for executing the Mais Visão program, started in 2020 by an agreement between the Government of Amapá and the NGO Centro de Promoção Humana Frei Samarate, known as Capuchinhos.

A publication on the state government portal states that the program received R$6.4 million in amendments from Alcolumbre. In this case, the amount indicated by the senator is allocated to the public body responsible for carrying out the action — the Government of Amapá.

On the same page, there is also a photo of the senator with the then governor Waldez Góes, an ally of the parliamentarian and current minister of Regional Integration and Development in the Lula (PT) government.

On his official website, the senator calls himself the creator of Mais Visão, with records of his visit to a service station in the municipality of Tartarugalzinho (AP). The program was also explored in its 2022 campaign material.

Furthermore, the publication states that the implementation of Mais Visão “only became a reality because of the allocation of Senator Davi’s parliamentary amendments to the project”.

“I usually say that Mais Visão is one of my most special dreams, which became reality for the state because it gives people back their vision, self-esteem, self-confidence, independence and autonomy”, states the senator in the text .

Mais Visão after patients lost their eyeballs due to an infection acquired in a group of surgeries on the program. Of 141 people treated, 104 had postoperative complications, including 40 serious cases.

In September last year, the judge reporting the case at the Amapá TRE, Carlos Augusto Tork, stated that “several steps were taken with a view to obtaining the information required in the case files”.

He added that, despite the Court’s efforts, “several of them proved fruitless due to the impossibility of providing the data or due to inertia on the part of the official bodies.”

Anac stated, in the process, that the passenger list is not required from private operators and that the agency’s technical areas do not maintain nominal information on transported passengers, “not being possible to comply” with the request made by the judge in the case.

Infraero also responded that it did not have the information, as, according to Anac regulations, “the
Airport administrators are not obliged to carry out civil identification of passengers”.

The hangar in the state of Amapá and Brasília International Airport also reported that they did not have images from cameras that could record the landing and disembarking of aircraft passengers.

The Electoral Committee pointed out that the delay and lack of evidence did not justify “the prolongation of the procedural investigation, especially given the need to observe the reasonable duration of the electoral process”, according to the judge.

On December 13, Tork ordered the inclusion of the action in the “first session” after the court’s recess, “to be held in February 2025.” There is still no set date for the trial, but it will take place after the election of the presidency in the Senate, from which Alcolumbre should emerge victorious.

Alcolumbre’s office stated that they were still awaiting confirmation from the court on a date for the trial.

In the case file, the senator’s defense stated that the Salomão Alcolumbre aerodrome is not used exclusively by the parliamentarian’s family and that, when searching on Instagram, “it is notable the presence of hundreds of photographs, almost all related to the practice of parachuting” in the location.

He also stated that dozens of steps have already been carried out, without even a single sign of alleged misuse being found and that, “given the non-obligation of a passenger list by the company, as a private operator, the request also appears to be innocuous”.

“There is no proof or indication of candidate Davi using a plane,” he said.

The company and the state government did not respond to contacts from Sheetcarried out by email and telephone.

In the process, Saúde Link’s defense stated that the requirement for proof that is impossible to produce, because it does not exist, “removes any possibility of liability or even conviction for the crime of disobeying a court order.”
