According to Gilmar Mendes, intervention should happen only when an entity approves rules that violate the constitution or legislation

The Brazilian Football Confederation () made an agreement with the Federal Supreme Court () that recognizes the legals of the CBF Extraordinary General Assembly and the election to the president of the entity. Thus, it must be kept definitively in office and end a long dispute that questioned the legitimacy of the leader. Prior to Ednaldo’s election in March 2022, the MP-RJ had questioned changes in CBF’s internal rules. When Ednaldo was elected, a Conduct Adjustment Agreement (TAC) was signed between entity and prosecution, to give stability to the claim.

In December 2023, the TJ-RJ tried the TAC legality and annulled the CBF assemblies that changed the format of the election in force when Ednaldo was elected. Thus, the president was removed from office, which generated concern for Conmebol and FIFA, who even named an intervener. The Supreme Court would resume on 14 March the trial that would define the future of Ednaldo Rodrigues at the CBF, as expected by Minister Flavio Dino’s office, who asked for views of the case in October. The court should judge if an injunction would be maintained or overthrown that reappointed the leader to the entity’s command.

The measure was issued by Gilmar Mendes, who was also the only one to vote before the trial is suspended. Gilmar Mendes maintained the position favorable to Ednaldo’s mandate and argued that the Supreme Court should prohibit state intervention in internal issues of sports entities, “particularly in relation to those conveyed to self -government and self -government” of these institutions. According to the minister, the intervention should happen only when an entity approves rules that violate the constitution or legislation, or in cases of investigation of criminal and administrative cases.

Meanwhile, CBF’s backstage politics continues. Recently, a change in the entity’s statute has been approved, ensuring that the confederation presidents may reelect twice, remaining in office for three consecutive terms. The rule that had been in force until then allowed only two mandates to be fulfilled, with only one reelection. The decision was unanimously approved by the federations. The idea is to bring the new status closer to the institution of other football regulatory bodies such as Conmebol and FIFA, which follow the same rule.

In the next election, unlike 2017, when Ednaldo had no competitors, he will be a candidate. The former player already articulates supports, including the choice of four-time champion Mauro Silva as one of his vices.
