The federal deputy (PSB-SP) filed a representation with the Public Ministry of São Paulo so that the (Companhia de Saneamento Básico do Estado de São Paulo) is investigated by , in the city center.

Contamination of drinking water caused vomiting and diarrhea among city employees who work there. The City of São Paulo, through the administration of , stated that an external infiltration affected one of the water reservoirs, which had already been isolated from the supply system.

The deputy asks that questions be sent to Sabesp to confirm whether the broken pipes on Rua São Bento and Avenida São João have a causal link with the hospitalizations in the Martinelli Building, a historic building in the city center and considered the first skyscraper in the capital.

If this happens, it requests that the individuals affected by the sewage leak be identified and that sanctions be determined for Sabesp to repair material and moral damage to the victims.

“The reports we received are of more than 90 people hospitalized and hundreds of incidents. These are employees who went to a normal day of work, drank water and finished their shift at the hospital. This is unacceptable. Responsibilities need to be determined”, says Tabata .

In the representation, Tabata says that all signs point to Sabesp’s responsibility for the contamination of the building’s water reservoirs. The deputy says that “there are enough elements to establish the causal link between this fact and the illness of many public employees.”

“Furthermore, as this episode originated in the public water system, it is possible that other economies were affected — and many more people were contaminated by the sewage leak”, he adds.

“There is evidence that Sabesp, as a concessionaire of public water supply and sewage services, failed in its obligation to maintain adequate service, threatening the physical integrity not only of São Paulo city hall employees in the Martinelli building, but of the entire population in the center of the capital, which is supplied by the pipes on Rua São Bento and Avenida São João”, he says.

She recalls that the Consumer Protection Code provides that the service provider is liable, regardless of fault, for repairing damages caused by defects relating to the provision of services. “This is the objective responsibility of the basic sanitation concessionaire.”
