Military police Vinicius de Lima Britto will go through the first instructional hearing on Wednesday (29), where it should be decided if the agent goes to the popular jury for the crime.
According to the São Paulo Court of Justice, the hearing will take place at the Barra Funda Criminal Forum.
REPROVATION IN PSYCHOLOGICAL TEST
Vinicius de Lima Britto, 24, executed Gabriel Renan da Silva Soares, 26, with 11 shots on November 3, 2024. He was arrested preventively on December 6 and is detained in the Romão Gomes Military Prison, in the northern zone of São Paulo.
The assessment, held during a public tender for 2nd class soldier, pointed out problems of sociability and emotional uncontrolled. After disapproval, Vinicius began a particular therapeutic treatment while trying to join the corporation again.
The information was confirmed to CNN by lawyers Victor Varvello and Carolina Marques Mendes, representatives of the police defense. After failure in the first attempt, Vinicius was approved in the test in a second contest, held in the same year.

Vinicius Britto’s defense states that Gabriel Soares, a man killed in Oxxo, simulated to have a gun after slipping on the market. The man would still have “stolen four times on the same day the establishment, offending the dignity of the employee with homophobic injury”, according to the defense.
According to the defense, the PM recovers from a trauma suffered in December 2023. At the time, Vinicius and a colleague were victims of an attempted robbery, in which a suspect “put the gun on his head”.
The policeman fired at the robber, who died. The defense reported that Vinicius was investigated by the action, but was not denounced by death.
Regarding the disapproval of the psychological test in 2021, the defense highlighted the seriousness of the exam. “The test has several phases, between writing, physical fitness and the last is the psychotechnical. The PM will only send to the street who is fit, to wear the uniform and carry a gun, ”said lawyer Victor Varvello.
Varvello also stated that Vinicius is a shooting instructor and an “extremely competent” person. In a statement, the defense also states that it is not justified to punish a crime with the life of the criminal.

Images from Oxxo Market Monitoring Cameras, on Avenida Cuppece, in the south of São Paulo, show that Gabriel Renan da Silva Soares was executed by the back by PM Vinicius de Lima Britto.
The version presented by the policeman was that the young man would have mentioned and made a movement in which he seemed to be armed, which, in his version, would justify the shots.
An attendant of the market corroborated the narrative, claiming that Gabriel would have said, “Don’t move with me, that I’m armed, I don’t want anything from you.”
However, the images show that Gabriel entered the store and runs after stealing cleaning items when it slips on the way out. The video shows the policeman hitting the victim in the back.
The São Paulo Public Security Secretariat reported that “relatives of the victim were heard and steps are underway to identify and qualify the witness who bumped into the victim during his escape from the commercial establishment, moments before being shot. The Military Police follow the investigations, providing support to the Civil Police. ”
