On Thursday, the Supreme Court (NS) of the Slovak Republic dismissed the appeal of financier Jaroslav Haščák in a lawsuit concerning the eavesdropping in the Gorilla case. This stems from the statement provided by Haščák’s lawyer Martin Škubla.

“At the same time, the NS SR referred Jaroslav Haščák to seek remedies before the Constitutional Court (ÚS) of the Slovak Republic, as the Civil Court cannot deal with such action,” He explained Škubla, who also confirmed that the ÚS SR on the Haščáková constitutional complaint in question. As he pointed out, the Gorilla case was already dealt with in 2012, when he stated the violation of the Rights of Varga by the Regional Court in Bratislava. “However, the dispute over the destruction of recordings and records of eavesdropping reached the European Court of Human Rights (ECtHR), which in 2021 and 2022 persisted interception records as an interference with the rights of Varga and Haščák. Subsequently, the dispute returned to the Slovak courts, who will order the destruction of the results of the eavesdropping – the Civil or Constitutional Court, “he added, adding that, as in the Varga case, the Constitutional Court will eventually decide in the case of Haščáková.

On Thursday, the National Council of the Slovak Republic announced an appellate judgment, dismissing the appeal of Haščák against the judgment of the Regional Court in Bratislava of September 2020.
