The Swiss Government stated that it had been commissioned by the Ministry of Justice to draw up the draft legislation by the end of 2026. The analysis carried out by independent experts has shown that even the strictest adoption laws cannot prevent abuse. The government had an independent assessment after the publication of two studies from recent years, which found that thousands of children could be illegally adopted from different countries from different countries.

“In the past, adoption from abroad has occurred inconsistencies in the past. The government regrets that the authorities have not fulfilled their obligations against children and their families, “the Cabinet said.

Independent experts were designed to examine whether and how the revision of legislation on adoption from abroad could prevent its abuse in the future. They concluded that measures at the national and regional level in Switzerland are sufficient, but it is not possible to completely prevent their abuse. The government also took into account the fact that their number has fallen sharply from several hundred to approximately 30 per year in deciding on a complete ban on adoption from abroad. At the same time, she stressed that adoption within Switzerland would remain legal.
