The (Attorney General’s Office) requested the conviction of the federal deputy (PL-SP) and hacker Walter Delgatti Neto for the crimes of invasion of computer device and ideological falsehood.
In final allegations sent to (Supreme Federal Court) on Friday (31), Attorney General Paulo Gonet states that there is “sufficient probative content” that the congressman “commanded the invasion of institutional systems” of the judiciary.
The case began in January 2023, when invasions were detected to the CNJ (National Council of Justice) systems with the insertion of false documents, including a forged arrest warrant against STF Minister Alexandre de Moraes for “criminal organization.”
In August of the same year, Delgatti was arrested and Zambelli became the target of search and seizure by the Federal Police. The PGR maintains that the deputy not only hired the hacker, but the text of the fake arrest warrant. For the prosecution, the crimes had “marked gravity” and aimed to “doubt the legitimacy and smoothness of the administration of justice.”
The prosecution says that Zambelli hired Delgatti and removed him through close people, who reportedly passed $ 13,500 to the hacker. The document cites that they were found on the cell phones of both identical files for a false arrest warrant against Moraes.
The lawsuit was reported by Moraes, in the first class of the Court, which in May 2024. At the time, the minister stressed that all the necessary elements were presented by the Attorney’s Office for the opening of the criminal action.
Minister Cármen Lúcia said she was beginning to worry “not only with the use of artificial intelligence, but with the natural disintelligence of some who act criminally.”
Zambelli’s defense, commanded by lawyer Daniel Bialski, said that “there is no effective evidence that she had collaborated, instigated and/or encouraged” Delgatti.
In addition, the defense has stated that “the absolute confidence that the deputy has not committed any criminal offense and is sure that this will be proven during the proceedings.”
Already the hacker confessed to the invasion of the system of in the police and said that it was sought by the deputy to demonstrate “fragility” of the Brazilian justice. The hacker’s lawyer, Ariovaldo Moreira, said after the complaint that his client “is a defendant confessed in the invasion of the CNJ, so it is no surprise the complaint to his disadvantage.”
