Senate has 101 projects ready for analysis

The congressman who assumes the presidency of the Senate Social Affairs Commission will have an extensive list of 101 projects ready to be analyzed.

Currently chaired by the Senator (PT-PE), CAS will be commanded by another senator or senator from February 2025. It is the Senator (MDB-PI).

All projects can already be guided to discussion and analysis by the 42 senators (21 holders and 21 alternates) that make up the board.

In all, there are 92 bills, 4 Legislative Decree projects, 3 Senate Bills, as well as 1 Complementary Bill and 1 Chamber Bill.

Labor market

  • PLS 277 of 2016: The text provides that companies with 50 or more employees will be required to fill some of the jobs with people with disabilities and rehabilitated social security beneficiaries. Locations with 50 to 99 employees should have at least one person with a disabled in the work framework. This number goes to 2% of total employees for companies that have between 100 and 200 employees.

  • PL 375/2023: The proposal amends Law 14,457 of 2022, which establishes the Employment + Women, to facilitate insertion in the labor market of women over 50 years.

Social

  • PL 3,131 of 2019 – The project modifies the ECA (Child and Adolescent Statute) to expand the list of neonatal diseases that must be tracked in Brazil. The article requires hospitals and other health care establishments for pregnant women, public and private, to perform tests for the diagnosis of cardiac, ophthalmological and orthopedic abnormalities of the newborn.

  • PL 5.225 of 2019 – The proposal states that maternity pay, when paid directly by the Social Security, is made available to the pregnant woman or the adopter within 30 days after your request. According to Cid Gomes (PSB-CE), there are reports that, in practice, in the case of maids, amounts related to the benefit have been paid by the INSS after 120 to 150 days of their request. “This makes it difficult for the survival of the worker and the newborn child, who do not have income during this period when they most need maternity allowance.”.

  • PL 3,242 of 2020 – The project inserts in the Elderly Statute the figure of the caregiver and exemplifies the activities performed. Gabrilli, rapporteur of the proposal, highlighted the importance of recognizing in the legislation caregivers of elderly, approved at the HDH (Human Rights Commission) in December 2023.

  • PL 1.901 of 2022: The proposal changes the National School Feeding Program to provide for students’ rights to at least 2 complete daily meals, thus fully meeting the recommended daily intake of protein, vitamins and minerals for each age group contemplated.

Health

  • PL 6.040 of 2019 – The project ensures that women who are until the 18th week of gestation and hire hospital health plans with obstetric coverage are entitled to full care. Also included would perform surgeries in case of need for hospital medical care due to gestational condition in urgent situations.
    The text amends Law 9,656 of 1998, which regulates the performance of private health care plans and insurance. By the current rule, the plans are required to cover unquestioning and urgency to comply with lack for those who already have health insurance. However, an ANS (National Health Agency) Precedent determines that if the pregnant woman has not yet met the maximum grace period of 180 days, the emergency care will be limited to the first 12 hours. After this period, if there is a need for hospitalization or exclusive procedures, the plan coverage is over.

  • PL 4.261 of 2021 – The proposal ensures the consumer’s right of health plans to request the portability of needs to any plan, from the same operator or other company, of greater or lesser value or coverage, as well as establishing criteria for migration.
