The president of the (Supreme Federal Court), minister, decided on Monday (3) that the investigation of the misappropriation of parliamentary amendments that cites Deputy Elmar Nascimento (União Brasil-BA) must be under the responsibility of the minister.
The decision to keep Kassio in the rapporteur contradicts a request from the Federal Police, who wanted the minister as responsible for the case.
Barroso understood that the investigation into the diversion of amendments involving the Bahian parliamentarian has no direct relationship with the actions reported by Dino, which deal with the transparency of resources.
“As indicated in the clarifications provided by the Federal Public Prosecution Service, there is no legal reason or intimate factual correlation that justifies the distribution of this done by preventing Minister Flávio Dino,” says Barroso. “Given the above, and without disregarding the reasonable doubt raised by the police authority, I determine the referral of the case to the minister [Kassio] Nunes Marques “he adds.
The controversy refers to Operation Overclean, which investigates, a federal authority linked to the Ministry of Regional Development. She went to the Supreme for quoting federal deputy Elmar Nascimento.
The impasse on the rapporteur of the case began on the 17th. The Federal Court of Bahia called for the investigation to be Dino, by prevention, according to which a process is with a certain minister who already deals with the same subject.
The acting president of the Supreme, Edson Fachin, understood, however, that the case should be distributed among the ministers. Kassio was drawn to stay ahead of the process.
In an atypical movement, the PF filed a request in the Supreme for the rapporteur to be delivered to Dino. “The two investigations are deeply connected, as both deal with the irregular use of parliamentary amendments, exposing corruption practices that affect both local and national levels,” the corporation said.
The PGR was called to manifest before the imbroglio. Paulo Gonet argued that there is no direct relationship between the two cases – and therefore, the investigation should be with Kassio, the draw.

Public resources from parliamentary amendments and agreements were diverted, according to investigations, to companies and individuals linked to municipal administrations.
According to CGU, the criminal organization moved by approximately R $ 825 million only in contracts signed with various public agencies.
The PF even arrested Francisquinho Nascimento (União Brasil), councilman in the municipality of Campo Formoso (410 km from Salvador). He was executive secretary of the City Hall commanded by Elmo Nascimento, brother of Elmar.
