Minister Alexandre de Moraes of the Federal Supreme Court (STF) asked the Secretariat of Penitentiary Administration of the State of São Paulo information on Walter Delgatti’s security at the Araraquara Provisional Detention Center.
The hacker’s defense, arrested for trying to break into cell phones from Lava Jato authorities and leak messages, claims that he has received “serious and frequent threats” at “life -threatening”.
Given this, the lawyers asked to be transferred to Tremembé Penitentiary 2 – known as the “Prison of the Famous”. At the scene are stuck people like former soccer player Robinho.
“The choice of this establishment is justified by housing detainees of cases of greater repercussion, in which the accused’s profile fits. Thus, it is presumed better prepared to preserve the integrity of the custodian, during the period in which it remains collected, ”says the defense.
The Attorney General’s Office (PGR) understands that the opinion of the administrator of the place where he is arrested today is necessary to give his opinion on the transfer.
“The definition of the prison establishment is subject to the possibilities of public administration, taking into account the principles of purpose, impersonality and public security. In this line of intellect, the claim of free choice of establishment by custodian lacks legal ballast, although, as a rule, it is recommended that the prisoner’s permanence is recommended near his social and family environment, ”said the PGR.
Moraes gave ten days for the São Paulo Penitentiary Administration Secretariat to speak out. In addition to reporting issues related to the security of the prisoner, the agency will also need to comment on the relevance and viability of transfer to Tremembé Penitentiary 2.
Prison
Hacker Walter Delgatti Neto was sentenced to 20 years and 1 month in prison in Operation Spoofing, which investigates leakage of conversations by Lava Jato authorities.
The operation was triggered in 2019. The intention was to investigate the invasion and the interception of private messages from then Minister Sérgio Moro and other authorities in the Telegram application.
Before entering the Jair Bolsonaro (PL) government, Moro was the judge responsible for Lava Jato in the 1st instance of the Federal Justice in Curitiba.
Delgatti is also arrested because of another investigation: the suspicion that he was paid by Mrs Carla Zambelli (PL-SP) to invade electronic systems of the judiciary.
