The new management of -RJ (Brazilian Bar Association NO), which took over in January, faces an internal crisis after dismissing more than 120 employees in the first month of office, on the grounds of correction of salary distortions.
Flasted claim that jams and drivers with low wages were dismissed along with the others.
OAB-RJ President Ana Tereza Basilio says there were drivers and waiters with higher salaries than the market average.
Under reserve, fired ears also speak of political motivation, because they would have entered the list of dismissal lawyers who supported the defeated plate in the November elections. Ana Tereza denies.
The case of layoffs was taken to the Labor Prosecutor’s Office, and a preparatory procedure is underway. The MPT said there were attempts at extrajudicial resolution, but to no avail.
The OAB-RJ had about 700 employees until mass dismissal.
The change in the entity is played after five years as vice president, Ana Tereza Basilio competed for the election and was elected in November, with 60% of the valid votes (31,810 votes). The defeated candidate Marcello Oliveira had 39.9% of the votes.
Ana Tereza’s main flag in the campaign was the reduction of OAB-RJ annuity, currently at $ 1,193, considered the most expensive in the country. She states that the entity reviews contracts with service providers and foresees the reduction of annuity from 2026.
“The reform is not yet to lower the annuity, but to pay the bills of everyday life,” says the president. “There were administration technicians who received $ 31,000 monthly, drivers who received $ 11,000, waiters with salaries of $ 7,000, values far above the market.”
Ana Tereza claims to have hired waiters with lower salaries and extinguished the position of driver.
On January 10, 121 employees were fired. Collaborators claim that an entire floor of Fluminense headquarters was reserved for dismissal examinations. Last week, another group of people was dismissed, and the current management confirms that more layoffs will take place in February.
In addition to 97 layoffs at the main headquarters, six people were fired at Barra da Tijuca Subsection and 18 others at Caarj (Rio de Janeiro State Advocacy Assistance Box).
The economy in the first wave of layoffs, according to the Order, will be $ 16.9 million. The president of the OAB says that the 2024 balance deficit was $ 28 million, which would have led the entity to seek loans.
Ana Tereza argues that the presence of stability in employment bonds has increased over the years the costs of payroll. The OAB was considered a federal autarchy until 1988. Today it has special regime municipality status.
In 2012, the OAB tried to dismiss employees, but the Labor Court determined relocation, arguing that the positions had stability. The case was taken by the OAB in 2021 to (Supreme Federal Court). In January this year, the Supreme Court acknowledged that the statuary regime is not compatible with the entity.
In a statement on January 17, the sectional said it met with the union of the category to communicate the beginning of layoffs. The Sinsafispro (Union of Servers of Rio’s Municipalities and Coalted Entities) said, however, that it did not attend meetings and that the OAB practiced “mass dismissal”.
Part of the dismissed created the defense movement to the OAB workers. In a statement released on social networks, the group states that layoffs scrapped the structure of the institution and that management “will implement the workers’ pejotization project”.
“I do not know all the dismissed employees. Several of them were hired by former managers of the Order who supported me in the election and were still fired. What happened was a search for very high salaries, incompatible,” says Ana Tereza.
