Authored by Deputies Luiz Carlos Hauly (Somos-PR) and Lafayette de Andrada (Republicans-MG), the proposal got signatures of 179 parliamentarians-the necessary 171 for a PEC to be filed.

This is not the first legislative initiative that discusses regime change. A referendum in 1963 and a plebiscite in 1993 rejected the change of this regime.

In recent interviews, the new mayor indicated to be in favor of discussing these topics.

There is still no clarity on which themes could be included in the bulge of discussions and, until then, Motta’s allies discarded discussions about changes in government regime in this collegiate.

The PEC filed on Thursday foresees the adoption of semi -presidentialism in Brazil.

She says the figure of President of the Republic continues to exist, but with limited powers. By the text, the president will continue to be the head of state and supreme commander of the Armed Forces, but there will be a prime minister-responsible for the administration of the government.

It will be up to the President of the Republic to appoint the Prime Minister, after consultation with the political parties that make up the majority, as well as the other members of the Council of Ministers. The president would also be responsible for sending bills to Congress and maintaining relations with foreign states, among other things.

The figure responsible for the administration of the government will be the prime minister, who will always be a parliamentarian chosen by the congress. It will be up to him to elaborate the government program, edit decrees and appoint positions of the federal administration.

The PEC also provides for the implementation of the mixed district vote for the election of federal deputies. The proposal says that the amendment will come into force on January 1, 2026, at the beginning of the last year of the term of the current president, Lula (PT).

There is still a long way for PEC to arrive at the House Plenary. First, the mayor must dispatch the proposal for analysis at the House CCJ (Constitution and Justice Commission).

Then, if approved by the CCJ, it will also be up to the president of the House to designate a special committee to deal with the merits of the proposal – there is a period of 40 sessions to vote the text, and the period for amendments runs out in the first 10.

After passing the Special Commission, PEC needs to be analyzed at the House Plenary, and 308 votes are required (513) for approval, in two voting shifts.
