The Court of Mato Grosso (TJ-MT) told the Supreme Court () that the servers and magistrates is legal and fulfills the function of “ensuring the coverage of the daily nutritional needs of the human person.”

Paid in December, the benefit became known as “Vale-Peru” and was suspended after the negative repercussion.

The demonstration of the TJ-MT was made after the minister to give five days for the president of the Court, Judge José Zuquim Nogueira, to explain the value. The monthly standard is $ 2,000.

In the document, TJ-MT says that the purpose of the administration was always to ensure that the food allowance would dignified the dietary expenses of the servers and magistrates.

“Such benefit should not be limited to a mere formal character, but to ensure the coverage of the daily nutritional needs of the human person, with dignity, balance and in accordance with good food practices,” said the president of TJ-MT.

According to the court, the magistrates returned the value. Most return by deposit or bank transfer. Others opted for full discount on the January payroll.

Servers even triggered the STF so as not to return the aid, claiming good faith.

In the manifestation sent to the Supreme, the TJ-MT cited the Constitution and the Minimum Salary as a guarantee of the vital needs of the worker.

“Because of this, it is even more evident that the judiciary has a duty to guarantee its servants and magistrates the full compliance with constitutional principles regarding subsidies and other funds they are entitled to.”

The court also stated that it is a punctual adjustment and that the amount of $ 10,000 is “quite reasonable” when diluted throughout the month of the year, which was not the case. “Budget limitations often make it impossible to grant continuous and permanent adjustments,” he says.

“Given this context, it is incontectly concluded by the strict legality of the payment idealized by this State Court, which was solely to ensure the full fulfillment of the function to which food aid is intended, without destroying values practiced By other Brazilian state courts, “wrote Judge José Zuquim Nogueira, president of TJ-MT.
