“Disseminate misinformation, foster hatred and violate the community’s right to reliable and safe information,” wrote the magistrate.
Pinheiro, however, accepted the deputy’s parliamentary immunity to deny the request for conviction for moral damages.
Advocates of the journalist, lawyers Igor Sant’Anna Tamasauskas and Beatriz Canotilho Logarezzi consider that “the sentence makes a correct analysis of the deputy’s false publications, but is contradictory in quoting the alleged existence of parliamentary immunity”.
With this, they intend to appeal to the Court to recognize the claim for compensation for moral damages. “Parliamentary immunity does not protect dishonest attitudes.”
