Minister Alexandre de Moraes of the Federal Supreme Court (STF) determined that the Federal Police (PF) speak out about the need to maintain the assets of the lieutenant colonel of the army Rafael Martins de Oliveira seized.
The military is a “black kid” – nickname who is part of the Army Special Forces. He is arrested in the context of the investigation that investigates an attempted coup d’état in 2022, to prevent the inauguration of President Luiz Inacio Lula da Silva (PT).
And the Federal Police completed the order on February 8, 2024. At the time of prison, the agents also seized some goods from Martins, such as cell phones and computers.
On Monday (10), the defense of Oliveira asked the minister to be returned. Lawyers claim that the seizure of goods is unjustified due to the time in which they remain retained.
“The maintenance of the seizure of the goods is not justified, mainly by the long interval of 1 year, and there is no current interest in such measure for the investigation of the inquiry,” said the lawyers in the request.
In the decision, Moraes gave five days for the PF to inform if there is a need to keep the goods in custody and determined that the opinion be sent to the Attorney General’s Office (PGR), which, after the PF, will have the same deadline to manifest.
Plan to kill authorities
Oliveira was under house arrest when he was the target of a Federal Police operation to investigate the coup plot. In November 2024, he was arrested preventively and is in a military penitentiary in Rio de Janeiro.

On Tuesday (4), the decision of the minister was made in response to a request from the defense of Oliveira, which requested the replacement of the prison for precautionary measures.
The lawyers claimed that there are no new facts that justify the detention and highlighted that others investigated and indicted in the case are free. However, Moraes disagreed with the defense’s arguments and decided to keep the arrest.
The PF points to the “black kid” as a participant in the “Copa 2022” scheme, in which, through a code name, would have planned, in a messaging group, the death of the three authorities to avoid possession of the Lula-Alckmin plate.
