Among the non -compliances pointed out by the PGR are Silveira’s departure from his residence at prohibited times, the frequent visit to public places and the unlavoded possession of a firearm.
“In other words, disrespect for the conditions of deliverance cannot, in the view of the Federal Public Prosecution Service, subject the re -educating sanctions applicable to the faults committed during the prison time. In this sense, revoked the right to their enjoyment, the conditions to be considered must be those prior to their concession, so that for those who were already in a more beneficial regime for serving penalty, there should be no regression, ”says the document Submitted to Supremo Tribunal Federal (STF).

The decree, which forgives penalties of pregnant women with pregnancy at risk, mothers and grandparents convicted of crimes without serious threat or violence, and other specific cases, does not apply to crimes by which Silveira was convicted.
