Former Boconist Criminal Criminal Criminalist Jorge Guaranho, 40, was sentenced on Thursday (13) to 20 years in prison closed by the murder of the municipal guard and petista militant Marcelo Arruda, then 50, in Foz do Iguaçu (PR ).

The sentence was read by Judge Michelle Pacheco Cintra Stadler of the 1st Private Court of the Jury Court, after the decision of the seven jurors, four women and three men.
Guaranho was accused by the public prosecutor of doubly qualified homicide, by (political divergence) and common danger (fire shots in an environment with others).
On July 9, 2022, Guaranho broke into Marcelo’s party, which celebrated 50 years old in a club in a club in Foz do Iguaçu, along with family and friends.
Marcelo wore a t -shirt with the image of then -candidate Lula, and the decoration made references to the PT, such as red balloons. Guaranho and Marcelo did not know each other, but, upon learning of the petista theme party, the first decided to go to the place shouting the name of Bolsonaro, in provocation to the guests.

In the testimony to the jury, Guaranho claims that she returned to the club because she would have noticed that her son of just over a month, who was in the car, was reportedly hit with a little land.

Still on the day of the crime, the second time he appeared at the party, Guaranho got out of the car and the civil policeman Pamela Silva, Marcelo’s companion, showed his badge, asking him to leave. But Guaranho saw Marcelo in the background, behind Pamela, and began to shoot him.
Marcelo was hit with two shots. He was taken to a hospital, but died at dawn the next day, July 10.
Throughout this week’s trial in Curitiba, held in three days, Guaranho’s defense supported a thesis in which Marcelo would have drawn the gun first and, therefore, the penal police officer would have shot himself to defend himself.
But the prosecutor stresses that the first to attack was Guaranho, who shot three times before Marcelo returned with six shots. In addition, the criminal expert reported that Guaranho and Marcelo made “simultaneous aimed”, that is, they pointed the gun at the same time.
The defense also emphasized the aggressions that the defendant suffered after shooting Marcelo.
Even lying after being shot by Guaranho, Marcelo managed to shoot the criminal policeman, who went to the ground and also took kicks from three men who witnessed the entire action. The aggression is the subject of another judicial procedure, in the process in Foz do Iguaçu, in which Guaranho figures as a victim.
In his speech to the jury, Guaranho brought a report about his physical condition today. He said he has projects on his body, two of them in his head, and had to have surgeries, such as a bone implant in his jaw. He added that the brain shot is what generated “the difficulty for me to walk.” Guaranho uses crutches.
Throughout the trial, prosecutors repeated that the episode of injuries was not being treated in the jury. They also stated that people who kicked Guaranho after the shooting reported acting for “panic and revolt” and that they are not responding for attempted murder.
The thesis of self -defense, repeated by the defenders of Guaranho, was, from the Court of Justice of Paraná, in September 2024, by authorizing the arrest of the defendant.
The judge’s speeches were used by the defense of Guaranho, who even exhibited some excerpts from the demonstration of the judge of second instance during last year’s trial.
Although he was under analysis a request from habeas corpus, Acácio even advanced on the merits of the case, stating that “the self -defense does not depart under any circumstances.”
“I would go further: to me it is the typical case of criminal action. Because it is evident that it was to kill or die,” said the magistrate. “The victim who died is a bold person, a violent human being, perhaps as much as the defendant,” he continued.
In May 2023, when granting a habeas corpus to another defendant for murder, Acácio said the victim was a person of “poor quality”, in a decision that at the time gained national repercussion. The speeches of the judge about the case of Guaranho are today the target of a representation in the CNJ (National Council of Justice).
